JIC RELEASE NO. 637 - DPHSS Issues Guidance Memo 2021-13

Today, the Department of Public Health and Social Services (DPHSS) issued DPHSS Guidance Memo 2021-13, relative to authorized businesses and services during Pandemic Condition of Readiness 3 (PCOR 3), in accordance with Executive Order No. 2021-08. DPHSS Guidance Memo 2021-13 supersedes all previous DPHSS guidance documents that are in effect, in whole or in part, including DPHSS Guidance Memoranda 2021-10, 2021-10 (Addendum No. 1), and 2021-08, which contradict or conflict with, Executive Order 2021-08 and DPHSS Guidance Memo 2021-13.

 

Effective at 8 a.m. today:

  • Indoor dining in an eating and drinking establishment, provided, it is limited to 75% of the occupancy load with no more than eight (8) persons per table per party, and each party is at least six (6) feet away from the other party

  • Movie theaters along with theater food concession operations may operate at up to 75% occupancy load

  • Organized sports, non-contact and contact training and competition is authorized with provisions which include, but not limited to:

    • the total number of persons shall be limited to no more than 50% of the occupancy load, which includes no more than 50 spectators in total, regardless of team affiliation – if held indoors 

    • the number of participants is limited to no more than fifty (50) persons with no more than fifty (50) spectators – if held outdoors

    • all athletes must wear face masks at all times when not actively participating in athletic activity

    • non-participants, such as instructors, employees, and parents must wear face masks at all times

  • Funeral ceremonies, both religious and non-religious, that are held indoors may operate at up to 75% of the occupancy load, and for associated activities (i.e., burial) held outdoors, it must not exceed 50 individuals and all must wear face masks and maintain 6 feet distancing

  • Services involving the administration of sacraments or celebration of high holy days are permitted at up to 75% occupancy load, including the clergy, minister, or other religious leader and his/her assistant, if necessary.

  • Public and private swimming pools may operate at up to 75% occupancy load

  • Gymnasiums, fitness centers and dance studios may operate at up to 75% occupancy load
